This Privacy Notice (the “Notice”) is provided to you to describe how Rise.ai E-commerce Solutions Ltd. (“Company”), and its affiliated entities, such as its subsidiaries, parent companies, or other controlled entities by them (each an “Affiliate” and collectively with Rise.ai E-commerce Solutions Ltd. referred to as “we”, “us”), collect, use, and share your personal information in connection with the access to or use of our website, services, applications, or other related digital presence online (the “Services”).
Each website visitor, subscriber, or user of the Services shall be referred to in this Notice as “User”. This notice also describes the rights and options available to our Users with respect to their personal information.
- The Scope of this Notice
1.1. Prior to any access or engagement with our Services, kindly read this Notice to better understand our practices and your rights. If following your review of the Notice you remain opposed to our practices, you must immediately leave and discontinue all use of any of our Services.
1.2. This Notice is not intended to override the terms of any contract you have with us, nor any rights you may have under other applicable data protection or privacy legislation. - Type of Information we collect We may collect information regarding our Users or others if applicable, including information relating to an identified or identifiable natural person (“Personal Information”), and non-personal technical information:
2.1. Information you provide us for the provision of the Services: when you register for our Services, or during your access to them, you may provide us with information such as name, email, address, phone number, email address, URL of your online stores, and orders history.
2.2. Information you provide us voluntarily as a visitor: when you sign up for events, subscribe to our blogs or newsletters; when you contact us directly by any communication channels on the Services or social media; when you interact with forms on our website or other third party services, you may provide us Personal Information, such as name, email address, phone number, or other information you may submit.
2.3. Information we collect when you use the services: when you visit, download, and/or use any of our Services, in addition to the information described above, we may collect technical information such as gift cards and store credit (such as amounts, balances, transactions, and redemptions), information related to orders made on your ecommerce website, settings defined by you on our platform, your ecommerce websites URLs, browsing and ‘click-stream’ activity on the Services, your ecommerce store’s currency, scrolls, non-identifying Personal Information such as the User’s device, operating system, internet browser, screen resolution, language and keyboard settings, etc.
2.4. Other sources: we may receive Personal Information about you from third-party sources, such as our business partners, website building platforms, social media channels, data enrichment services. This Personal Information varies from source to source, and may include purchase history, contact information, billing information, addresses, preferences, or other information relevant to the Services.
2.5. Users of Users: we may also collect Personal Information pertaining to visitors and users of our User’s websites or services (“Users of Users”), solely for and on our Users’ behalf. This Personal Information may be collected directly by us for the purpose of provisioning the service, or by third parties. In our collection of Personal Data of Users of Users, the collection shall be governed by our Data Processing Addendum available at https://rise.ai/data-processing-addendum/, which under you shall be considered as the Controller of any data of Users of Users, and we shall be considered as Processors as defined under the European General Data Protection Regulation (2016/679) (the “GDPR”) or other similar data protection legislation, or as “Service Providers” as defined under the California Consumer Privacy Act (the “CCPA”). - Why do we collect this information
3.1. To provide and operate the Services;
3.2. To further develop, customize, train, expand, and improve our systems and Services;
3.3. To provide our Users with ongoing customer assistance and technical support;
3.4. To be able to contact our Users with general or personalized service-related notices and promotional messages;
3.5. To comply with any applicable laws and regulations;
3.6. To help us to update, expand and analyze our records to identify new customers;
3.7. To analyze our performance and marketing activities;
3.8. To create aggregated statistical data and other aggregated and/or inferred information, which we or our business partners may use to provide and improve our respective services; - Legal Basis
We use the Personal Information for the purposes set out in this notice when:
4.1. Performance of Contract: Our use of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you. This may include your name, email address, store URL, billing information, or other similar information;
4.2. Legal Obligation: Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that we have; or
4.3. Legitimate Interest: Our use of your Personal Information supports legitimate interests and business purposes (for example, to maintain and improve our Services and our effectiveness by identifying technical issues, answering questions or providing other types of support, and prevention of risk and fraud), provided it is conducted in a way that is proportionate and that respects your privacy rights. This may include information provided while visiting our website, engaging with our social media, general metrics of your use of our Services, purchase history, or other related information; or
4.4. Consent: Our use of your personal data is pursuant to your consent, which can be withdrawn any time as further detailed in this notice. - With Whom We Share Your Personal Information:
5.1. Third-Party Service Providers: in order to provide you with the Services, we partnered with a selected number of service providers, whose services and solutions complement, facilitate and enhance our own. We have contractual obligations in place with each of these service providers to ensure that (i) they maintain proper security measures to protect your information, and (ii) the use of the Personal Information shall be limited to the purpose of its disclosure.
5.2. Law Enforcement or Legal Duties: we may disclose or otherwise allow access to any categories of your Personal Information described in this Privacy Policy pursuant to a legal request, such as a subpoena, legal proceedings, search warrant or court order, or in compliance with applicable laws if we have a good faith belief that the law requires us to do so, or it is necessary for protecting other rights (such as property, privacy, or others) of us, other Users or Users of Users, and third parties.
5.3. Affiliated Parties: we may share your Personal Information with our Affiliates, in accordance with this Privacy Policy, for the purpose of providing the Service, improving our Service, or collaborating with other services.
5.4. In connection with a change in corporate control:in addition, should we or any of our Affiliates undergo any change in control, including by means of merger, acquisition or purchase of substantially all of our assets, your Personal Information may be shared with the parties involved in such event.
Upon Your Further Direction:we may enable you, through different techniques, to engage and procure various third party services, integrations, products and tools, applications and widgets offered to you by third parties through our Services. If you choose to engage with such Third Party Services, they may have access to and process your Personal Information of your Users-of-Users Personal Information. - Storage and Transfer of Personal Data:
6.1. Storage and Transfer: Company stores all the information we collect subject to this Privacy Notice in our databases located in the United States, after deploying all the necessary security measures to protect your data. Your security, privacy, and confidentiality are our top priority and that’s why we conduct a vetting process that includes an assessment of the privacy laws in countries we transfer your personal information to in order to validate they have strong data protection laws. Therefore, when we transfer Personal Information originating in Europe to a location outside of Europe, we will make sure that (i) there is a level of protection deemed adequate by the European Commission or (ii) that the relevant Standard Contractual Clauses are in place (i.e., the applicable module of the Standard Contractual Clauses for the transfer of personal data to third countries pursuant to the GDPR and the decision of the European Commission from June 4, 2021, and the ICO’s International Data Transfer Addendum to the E.U. Commission Standard Contractual Clauses, as it is revised under Section 18 of its Mandatory Clauses) as updated by the regulators from time to time, or (iv) use another legally recognized transfer mechanism in the applicable jurisdiction. When we transfer Personal Information to a party in a third country that is not considered by the applicable regulator as one that adequately protects your information, we will ensure that such third party has taken additional measures to protect your information, privacy, and compliance with the relevant data protection laws.
6.2. Retention: We may retain your Personal Information (as well as your Users of Users’ Personal Information) for as long as your user account is active and as indicated in this Privacy Policy, or as otherwise needed to provide you with our services. We may continue to retain your Personal Information after you cease to use our services, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our Users or their Users of Users, prevent fraud and abuse, enforce our agreements and/or protect our legitimate interests. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of such data, the potential risk of harm from unauthorized use or disclosure of such data, the purposes for which we process it, and the applicable legal requirements. - Cookies and Similar Technologies:
7.1. We may use cookies, or other similar technologies, such as Tags, or Pixel Tags during the performance of our services and website, as described below (altogether “Cookies and Tags”). We use first-party Cookies and Tags to provide you with the Services, ensure they perform properly, and personalize our services, for example, based on your device used, browser of choice, or other similar purposes. We may also use third-party Cookies and Tags, in order to personalize your experience, improve our services or offerings, analyze our performance and marketing activities, or other similar purposes. 8.1. We may use your Personal Information to send you promotional content and messages by e-mail, text messages, notifications within our platform, marketing calls, and similar forms of communication from Us or our partners (acting on our behalf) through such means. If you do not wish to receive such promotional messages or calls, you may notify us at any time or follow the “unsubscribe” or STOP instructions contained in the promotional communications you receive. - Your Rights Regarding Your Personal Information
9.1. We respect your control over your Personal Information. You have the right to be informed about our data-collection practices, and our use of your information.
9.2. You may have the right, in accordance with the applicable laws, to request access, copy, update, amend, delete, and port certain Personal Information we collect about you.
9.3. You have the right to object to our processing activities in accordance with the applicable laws.
9.4. You may also have the right, in accordance with applicable laws, to request that we restrict the processing of your Personal Information under certain circumstances.
9.5. In accordance with the applicable laws, you have the right not to be subjected to automated decision-making that produces legal effects or other significant effects concerning you. More information can be found under Section 4 of this Notice.
9.6. When we receive your right request, we may take steps to verify your identity in order to protect your privacy and security. We will make reasonable efforts to honor your request promptly (unless we require further information from you in order to fulfill your request). It shall be clarified that compliance with the request is subject to the applicable data protection legislation, and we will consider each request subject to the legal circumstances.
9.7. We do not charge our Users for exercising their rights, however, we reserve the right to charge a fee where permitted by law, when requests are excessive or repetitive.
9.8. When we rely on your consent for the processing of your Personal Information you can withdraw your consent at any time, and such withdrawal will take effect from thereon.
9.9. You have the right to file a complaint with your local supervisory authority for data protection.
9.10. We do not discriminate against any individual for exercising their rights under this section. If we deny your request or cannot fulfill it, you may appeal our decision by contacting us as described in this Privacy Notice to ask us to review your request again. Your communication should include “Appeal” in the subject line. When making a lawful request, we may request to verify your identity to prevent fraud, especially as it may result in loss of data. - Additional Information for U.S. State Residents
10.1. This section of our Notice details what information we collect about you and other privacy practices under applicable U.S. privacy laws and regulations, the sources of the Personal Information, the purposes of use and disclosure, and the categories of third parties that may receive that Personal Information.

10.2.8.1. Information you provide us when you register to our Services, events, subscribe to our blogs or newsletters, or contact us directly via our communication channels.
10.2.8.2. Information generated during your use of our Services.
10.2.8.3. Information that was gathered from third-party sources, such as security providers, fraud, detection services, social media platforms, lead enhancement companies, and advertising and marketing partners.
10.3. Disclosure of information for Business Purposes: In the past 12 months, we may have disclosed or shared each of the categories of personal information above to our Affiliates, third-party service providers, social media platforms, advertising partners, analytics partners, and promotional partners.
10.4. Sales or Sharing of Your Information: For sure, we’re not out there auctioning off your data to the highest bidder. We may have “sold” (using that rather broad and dramatic term as defined by U.S. privacy laws and regulations) or shared the categories of Personal Information listed above in the past 12 months to our Affiliates, third party services providers, promotional partners, advertising partners, analytics partners, and social media platforms. We do not knowingly collect, use, sell or share the Personal Information of children under the age of 16.
10.5. Retention:
10.5.1. We retain your Personal Information for the time period reasonably necessary to achieve the purposes described in this Privacy Policy, or any other notice provided at the time of collection.
10.5.2. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of such data, the potential risk of harm from unauthorized use or disclosure of such data, the purposes for which we process it, and the applicable legal requirements.
10.6. Your rights:
10.6.1. If you are a United States citizen, various laws may apply to our collection of your data depending on the state. Here is a brief summary of location-specific rights depending on your location or residency:
10.6.2. Right to delete your information: upon your request, we will delete the personal information we have collected from you, subject to certain legally permissible exceptions.
10.6.3. Right to know and access your personal information: You have the right to ask us to confirm whether we process your personal information and for a copy of the personal information we maintain about you.
10.6.4. Right to correct inaccurate personal information.
10.6.5. Right to opt out of the sale of your Personal Information: you can tell us not to “sell” your personal information according to applicable law, even though we do not technically sell your information in the traditional sense.
10.6.6. Right to limit use of your Personal Information for targeted advertising: You can ask us not to use or disclose your personal information for targeted advertising.
10.7. Exercising your rights:
10.7.1. You may exercise your rights by sending your request to privacy@rise-ai.com, or by mailing it to Rise.ai E-commerce Solutions Ltd, 5 Yunitzman St., Tel Aviv 6350671, Israel.
10.7.2. No Discrimination. Rise does not discriminate against any individual for exercising their rights under this section. If we deny your request or cannot fulfill it, you may appeal our decision by contacting us as described in this Privacy Notice to ask us to review your request again. Your communication should include “Appeal” in the subject line.
10.7.3. You may designate an authorized agent to submit a request on your behalf.
10.7.4. Depending on the nature of the request, we may authenticate the request by requesting additional information or documentation, such as account-related information, billing information used to purchase paid Services and the submission of specific documents.
10.8. Necessity: Please note that some of the Personal Information provided by our Users including but not limited to name, email, and identifiers (collectively the “Necessary Data”) is necessary in order to provide the Services or certain features of it, and we will not be able to provide them without it. It shall be noted that any request to delete such Necessary Data may result in our inability to provide the Services or certain features, and/or the deletion of the account, which is an irreversible action, which may trigger the deletion of all of your data. - Children’s Information
11.1. We will not knowingly collect Personal Information from children under the age of 16, and if such information was collected unknowingly, it shall be deleted without undue delay upon discovery. - Contacting Us

12.4. Our Data Protection team will investigate the complaint and determine whether a breach has occurred and what action, if any, to take. We take every privacy complaint seriously and will make all reasonable efforts to resolve your complaint promptly and in accordance with applicable law.
12.5. If you wish to exercise any of your rights under the applicable laws or this Privacy Notice, kindly send us an email with your details and your request to privacy@rise-ai.com, and we will process it shortly.
12.6. You can file a complaint with your local supervisory authority for data protection at any time, however, we recommend that you contact us first so we can try to resolve it. - General
13.1. This Privacy Notice may be updated or changed from time to time, thus we urge you to review it frequently. For your convenience, we will mark the last edit to the Privacy Notice, and where reasonable, provide you with a notice of such change.
